These Terms and Conditions (hereinafter the “Terms”) govern all bookings, purchases, services, and use of facilities provided by 124 on Queen Hotel and Spa (hereinafter referred to as “the Spa” or “the Hotel” interchangeably from herein).

By booking an appointment, purchasing a service or gift card, entering the Spa premises, or using any Spa services or facilities, you agree to be bound by these Terms.

I. Area of Applicability

These Terms apply to all spa services and facilities, including but not limited to:

• Hydrotherapy circuit and wellness facilities
• Massage therapy and body treatments
• Facials, skincare, manicure, pedicure, and nail services
• Wellness therapies, enhancements, and add-on services
• Treatment rooms, relaxation areas, and common spaces

Should the Spa update its general terms and conditions before the termination of the contract, the updated version will be incorporated into the contract if the contracting party is informed in writing and does not object within 14 days.

The customer’s general terms and conditions will only form part of this contract if the hotel consents in writing, either in whole or for individually specified points.

II. Bookings And Contract Formation

A booking is formed when:

• a guest submits a booking request online, by phone, or in person; and
• the Spa confirms the booking verbally, electronically, or in writing.

If a booking is made by a third party on behalf of a guest, both the third party and the guest are jointly responsible for compliance with these Terms.

All bookings are subject to availability.

III. Services, Prices, Payment, And Billing

The Spa agrees to provide the services booked by the guest.

The guest agrees to pay the prices in effect at the time of booking for all services rendered, including applicable taxes. Gratuities are discretionary.

Payment is due at the time of service unless otherwise agreed. The Spa may require:

• advance payment,
• a credit card guarantee, or
• a deposit for certain services, packages, or group bookings.

The Spa reserves the right to pre-authorize credit cards prior to appointments.

IV. Appointment Policies And Arrival

Appointments may be made online, by telephone, or in person, and are subject to availability and confirmation by the Spa. A valid credit card may be required to secure appointments, and certain services, packages, or events may require a deposit or advance payment.

Guests are encouraged to arrive at least 15 minutes prior to their scheduled appointment to allow sufficient time for check-in, consultation, and completion of any required intake forms or consents.

Late arrivals may result in shortened treatment time without price reduction, in order to avoid delays to subsequent guests.

The Spa does not guarantee a specific service provider unless expressly confirmed in writing.

V. Cancellations, Rescheduling, And No-Shows

Cancellation and rescheduling policies are communicated at the time of booking and may vary by service or group size.

Unless otherwise stated at the time of booking:

• Late cancellations or no-shows may be charged all or part of the service fee, up to the full value of the booked service; and
• Prepaid services, packages, and promotional offerings may be non-refundable.
• We reserve the right to charge in full for appointments where the guest has cancelled within 48 hours (or 7 days for group bookings) of the appointment start time.

VI. Health Disclosure And Guest Responsibilities

Guests are responsible for:

• disclosing all relevant medical conditions, allergies, injuries, pregnancy, or sensitivities;
• following staff instructions and posted Spa rules; and
• immediately advising staff of discomfort during services.

The Spa reserves the right to refuse or discontinue services if it believes participation may pose a risk to the guest or others.

VII. Minors

Access to Spa facilities and services by minors is subject to age restrictions, supervision requirements, and service-specific policies as posted on the Spa premises or communicated at the time of booking. Although we are an adult-only facility (18 years and older), children aged 13 and older may book manicures and pedicures if accompanied by an adult. However, guests must be 16 years or older to enter our hydrotherapy circuit.

Minors may only receive treatment with the informed consent of a parent or legal guardian, who must execute any required waivers or consent forms on the minor’s behalf.

Certain services may be restricted or unavailable to minors. Where massage therapy or other regulated health services are provided, consent, treatment standards, and draping practices will comply with applicable professional and regulatory requirements, including those of the College of Massage Therapists of Ontario, where applicable.

Parents and guardians are responsible for the conduct, supervision, and safety of minors while on the Spa premises

VIII. Hydrotherapy And Wellness Facilities

Use of the hydrotherapy circuit and wellness facilities is at the guest’s own risk.

No lifeguard is on duty. Guests are responsible for monitoring their own physical condition.

Access to hydrotherapy facilities may require execution of a separate waiver and release.

IX: Personal Property

The Spa is not responsible for loss, theft, or damage to personal property brought onto the premises, including clothing, jewelry, or valuables.

Lockers are provided for convenience only and do not constitute safekeeping.

X. Conduct And Safety

Guests must conduct themselves in a respectful and lawful manner.

The Spa may refuse service or require a guest to leave the premises for:

• inappropriate conduct,
• intoxication,
• harassment of staff or guests, or
• failure to comply with Spa policies.

No refund will be provided in such circumstances.

XI. Waiver And Assumption Of Risk

Use of Spa facilities and participation in services involves inherent risks.

Where required, guests must sign a separate waiver, release, and assumption of risk agreement, which forms part of the contractual relationship between the guest and the Spa.

Nothing in these Terms limits or excludes liability for professional negligence or other liability that cannot be excluded by law.

XII. Limitation Of Liability

To the fullest extent permitted by law:

• the Spa shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of enjoyment or opportunity; and,
• the Spa’s total liability for any claim arising from a service shall be limited to the amount paid by the guest for the specific service, giving rise to the claim (i.e. if your massage service was $200.00, your maximum recovery for any lawsuit, would be $200.00).

This limitation does not apply to liability that cannot lawfully be limited.

XIII. Consumer Protection

Nothing in these Terms limits any rights or remedies available under the Consumer Protection Act, 2002 (Ontario) or other applicable legislation that cannot be waived.

XIV. Privacy And Personal Information

The Spa collects, uses, and discloses personal information only for purposes reasonably necessary to provide spa services, manage bookings, process payments, and comply with legal and regulatory obligations.

Personal information is safeguarded using reasonable administrative, technical, and physical measures.

Where services require the collection of health-related information, such information is used solely for service delivery and safety purposes and is accessed only by authorized personnel.

Guests may request access to or correction of their personal information by contacting the Spa.

XV. Governing Law And Jurisdiction

These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

Any disputes shall be subject to the exclusive jurisdiction of the courts of Ontario.

XVI. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
